Description
This new Counsel role is to join the members of the General Counsel’s Office in London who support the PCS (Proprietary Card Services) business unit with support also for litigation matters in other business units and World Service in the UK, EMEA and International. The main responsibility of this role is to lead the management of UK litigation relating to the PCS business unit with support also for litigation matters relating to other business units. It would entail supporting the team in delivering on the following main responsibilities:
- Leading the management of litigation relating to the PCS UK business unit, primarily consisting of litigation involving Consumer cardmembers including the development of an overall litigation strategy and the conduct of individual cases. Typically involves issues relating to consumer credit, consumer protection and other aspects of financial services regulation.
- Support and/or manage litigation relating to other UK Lines of Business, predominantly of a commercial nature.
- Monitoring and participating in external environment in order to identify trends in consumer litigation and complaints and developing strategies for responding to those trends.
- Providing strategic legal support for Complaint handling and Collections teams to allow effective management of all complaints and active litigation including FOS complaints and defended collections litigation.
- Responsible for working with external counsel in order to ensure cost-effective, commercial, risk-based management of litigation risk.
- Provision of legal support for the PCS business and the World Service function in the UK, EMEA and International directly and through cost-effective reliance on external counsel. In broad terms, responsibility includes helping the business to ensure its business activities are conducted in accordance with applicable laws and regulations, and identification and effective management of litigation risks arising from these activities.
- Providing litigation risk support and insights for business projects and initiatives at UK, EMEA and International level, including new product development, business re-engineering initiatives, marketing and digital initiatives.
- Monitoring, lobbying, managing and effective implementation of relevant legislative developments at the UK and EMEA level.
- Proactive role in making sure senior management and business teams support the litigation strategy adopted, and that measures are implemented by the business to mitigate the risk of litigation and complaints arising.
- Partnering and alignment with local market, EMEA and International GCO, Compliance and Operational Risk teams as necessary in support of business, GCO, Compliance and Operational Risk initiatives.
- Carrying out legal research and requesting, obtaining and finalising legal opinions from outside counsel(s) as needed.
- Effective partnering with other relevant support functions in management and resolution of projects and initiatives (e.g. Complaint Handling teams, Global Credit Administration, Risk, Public Affairs, Finance, etc).
- Producing litigation reports in a timely manner.
- Assisting in management of all relationships with local regulators of the PCS business in the UK.
- Keeping local management aware of all matters which represent a significant litigation, regulatory and/or financial exposure to American Express or a risk to the American Express brand.
- The management of external legal counsel and external counsel legal fees.
- Managing a paralegal who will assist in litigation matters.
- Other responsibilities as assigned by the manager from time to time.
The position is based in our offices in London (Victoria) and travel will be required in order to best support the needs of the business and the demands of particular projects. This position will be supported by an Executive Assistant shared by other London-based lawyers in the same team. In addition, GCO EMEA resources are in place to assist in managing budgets, tracking litigation and managing company secretarial matters.
Qualifications
- English Law legal qualification.
- Post qualification experience, including in-house experience.
- Fluent in English and preferably (but not required) another European language.
- Experience working in the financial services, payment card or related payment systems area.
- Experience in the management of a consumer/retail litigation portfolio including current knowledge of payment services, consumer credit, consumer protection legislation and related regulations, data protection and privacy and other legal and regulatory requirements applicable to financial and payment services is essential.
- Understanding of banking and insurance regulatory laws, travel and competition laws and familiarity with extraterritorial U.S. laws and regulations affecting global financial services businesses (anti-money laundering, Foreign Corrupt Practices, antitrust, etc).
- Experience in handling regulatory issues and in maintaining relationships with regulators and industry associations.
- Experience in acting as legal adviser in new product development and implementation.
- Experience in advising on legal issues relating to provision of financial services electronically and via mobile.
- Familiar with project management, in particular the areas of outsourcing and re-engineering projects.
- Experience in managing budgets, both internal such as travel and expense related as well as external such as external counsel related.
